These Terms of Service (“Terms”) govern your access to and use of the What Hatch Can I Match website, mobile application, software, and related services (collectively, the “Service”). The Service is operated by Shaftoe Consolidated (“What Hatch Can I Match,” “Company,” “we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
What Hatch Can I Match is a fly-tying organization and decision-support platform designed to help users manage fly-tying materials, explore fly patterns, determine which patterns they can tie using available materials, identify possible substitutions, maintain finished-fly inventories, explore hatch-related patterns, and manage related information. Features may include: • My Desk material inventory management; • Fly pattern information; • Material and substitution matching; • “What Can I Tie?” functionality; • “Fish This Hatch” functionality; • Shopping-list recommendations; • Finished-fly and Fly Box inventory management; • Pattern and material submissions; • Achievements and gamification; • Links or references to third-party tying instructions and content; and • Other features introduced from time to time. We may add, modify, suspend, or discontinue features at any time.
2. Eligibility
You must be legally capable of entering into these Terms. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and permission of a parent or legal guardian. The Service is intended primarily for users located in the United States unless we expressly state otherwise.
3. Accounts
You may create an account using: • Google authentication; or • An email address and password. You agree to provide accurate and current account information. You are responsible for: • Maintaining the confidentiality of your account credentials; • Restricting unauthorized access to your account; • Activities occurring through your account; and • Promptly notifying us of suspected unauthorized access. You may not: • Share your account in a manner inconsistent with your subscription; • Impersonate another person; • Create accounts for fraudulent or abusive purposes; • Circumvent account or subscription restrictions; or • Use automated means to create accounts. We may suspend or terminate accounts that violate these Terms.
4. Subscriptions and Free Trials
The Service may offer a fourteen (14)-day free trial and a paid six-month subscription. The intended subscription price is: $5.00 per six months Prices may change in the future. Any applicable taxes may be added where required. Free Trial If offered, a free trial provides temporary access to eligible subscription features for the stated trial period. Unless otherwise stated at enrollment, the trial begins when you activate your account or subscription. We may modify, limit, or discontinue free trials at any time. Paid Subscriptions Paid subscriptions may automatically renew unless canceled before the applicable renewal date, subject to the terms presented during purchase. The exact billing, renewal, cancellation, and refund terms presented through the applicable payment processor or app marketplace may also apply.
5. Cancellation and Refunds
You may cancel your subscription using the subscription-management tools made available to you. Cancellation generally prevents future renewal but does not necessarily terminate access immediately. You may retain access through the end of the current paid subscription period unless otherwise stated. Refunds, if any, will be handled in accordance with: • Applicable law; • The policies of the payment processor; • The policies of the applicable app marketplace; and • Any refund policy presented at the time of purchase. Nothing in these Terms limits rights that cannot legally be waived.
6. My Desk and User Inventory
“My Desk” allows users to record and manage fly-tying materials and related inventory information. You are responsible for the accuracy of information entered into your My Desk inventory. The Service may use your inventory information to generate: • Pattern matches; • Material recommendations; • Substitution suggestions; • Shopping recommendations; • Inventory summaries; and • Other related results. These results are informational recommendations only. We do not guarantee that: • A listed material is currently available for purchase; • A substitution will produce identical results; • A recommended pattern is appropriate for a particular fishing situation; or • A pattern can be successfully tied using the materials listed.
7. Pattern Matching and Substitutions
The Service may classify patterns using categories such as: • Ready to Tie; • Tieable with Substitutions; • Missing Materials; or • Similar or Related Patterns. These classifications are generated using available pattern information, your inventory information, and applicable material relationships. Fly tying involves subjective choices. A material identified as a substitute may not be equivalent to the originally specified material. You are responsible for determining whether any material, substitution, pattern, hook, technique, or finished fly is appropriate for your intended use.
8. Fish This Hatch
The “Fish This Hatch” feature may associate insect or hatch information with fly patterns. Hatch information and pattern recommendations are provided for informational and educational purposes. We do not guarantee: • That a particular hatch is occurring; • That a hatch is occurring at a particular location; • That a pattern accurately imitates a particular insect; • That a recommended fly will catch fish; or • That the information is current for a particular stream, river, lake, season, or geographic location. Fishing conditions vary significantly. Users should independently evaluate local conditions and comply with all applicable fishing laws and regulations.
9. Shopping Recommendations and Third-Party Links
The Service may recommend materials that could unlock additional patterns. For example, the Service may indicate that purchasing a particular group of materials could make additional patterns available to tie. These recommendations are estimates based on available information. The Service may contain links to: • Retailers; • Manufacturers; • Fly shops; • Instruction websites; • Videos; • Content creators; and • Other third-party services. Some links may be affiliate or promotional links. We may receive compensation if you purchase products or services through certain links. Where required, we will provide appropriate disclosures. We do not control third-party websites, products, prices, inventory, shipping, content, or services. Your relationship with a third party is governed by that third party’s terms and policies.
10. Pattern Information and Instruction Links
The Service may provide information about fly patterns, including: • Pattern names; • Categories; • Materials; • Hook information; • Difficulty; • Variations; • Authors or originators; • Historical information; and • Links or references to tying instructions. Instruction links may direct users to third-party websites, videos, books, publications, or other sources. Unless expressly stated otherwise, What Hatch Can I Match does not claim ownership of third-party instructional content. Users must comply with the terms and intellectual-property rights applicable to third-party content.
11. User Submissions
Users may be permitted to submit: • Fly patterns; • Pattern variations; • Material information; • Material substitutions; • Photographs; • Comments; • Corrections; • References; • Links; and • Other content (“User Content”). Submitting User Content does not guarantee publication. We may review, edit, normalize, reject, remove, or decline to publish User Content. Pattern and material submissions may require administrative approval before becoming publicly available.
12. Your Responsibility for User Content
You represent and warrant that: 1. You own the User Content or have all necessary rights to submit it; 2. Your submission does not violate another person’s intellectual-property rights; 3. Your submission does not violate applicable law; 4. Your submission is not knowingly false or misleading; 5. You have obtained necessary permissions for any copyrighted material, photographs, or other protected content; and 6. You have authority to grant the license described in these Terms. Do not submit content copied from websites, books, magazines, instructional publications, videos, or other sources unless you have the legal right to submit that content. Providing a link to publicly available content is not necessarily permission to reproduce that content.
13. License to User Content
You retain ownership of your original User Content. However, by submitting User Content to the Service, you grant Shaftoe Consolidated a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to: • Store; • Reproduce; • Format; • Modify; • Normalize; • Categorize; • Translate; • Display; • Distribute; • Publish; and • Use the User Content as reasonably necessary to operate, improve, promote, and provide the Service. This license includes the right to transform submitted material information into standardized material records and to associate submitted information with patterns, materials, hatches, substitutions, and other database records. To the extent permitted by law, this license continues for published or incorporated User Content after your account is deleted when necessary to maintain the integrity of publicly available records or derivative database relationships.
14. Content Moderation
We may, but are not obligated to: • Review User Content; • Remove User Content; • Reject submissions; • Correct information; • Merge duplicate records; • Normalize terminology; • Restrict users from submitting content; or • Suspend accounts.
15. Intellectual Property
The Service and its original content may include intellectual property owned by or licensed to Shaftoe Consolidated. This may include: • Software; • Source code; • Databases; • User-interface designs; • Graphics; • Logos; • Trademarks; • Original text; • Material classifications; • Data relationships; • Pattern organization; • Matching methods; • Substitution relationships; and • Other proprietary components. Except as expressly permitted, you may not copy, reproduce, distribute, sell, license, scrape, extract, reverse engineer, or create derivative works from protected portions of the Service.
16. Restrictions on Data Extraction
You may use the Service for personal and legitimate purposes. You may not, without our written permission: • Scrape the Service; • Use bots to collect information; • Systematically extract pattern information; • Systematically extract material information; • Download or reproduce substantial portions of our database; • Create a competing database using information extracted from the Service; • Circumvent access controls; • Attempt to obtain bulk data not intentionally provided to you; • Reverse engineer proprietary portions of the Service; or • Interfere with the operation or security of the Service. Nothing in these Terms prohibits activity that cannot legally be restricted.
17. Acceptable Use
You may not use the Service to: • Violate applicable laws; • Infringe intellectual-property rights; • Submit fraudulent information; • Harass another person; • Distribute malicious software; • Interfere with the Service; • Circumvent security controls; • Attempt unauthorized access; • Abuse free trials; • Manipulate achievements or gamification systems; or • Create fraudulent accounts.
18. Gamification and Achievements
The Service may award badges, achievements, points, statistics, or other virtual recognitions. Unless expressly stated otherwise, these have no monetary value and may be modified, corrected, removed, or discontinued.
19. Administrative Roles
Certain users may receive administrative privileges. Administrative access is granted at the Company’s discretion. Administrative privileges may include the ability to: • Add or edit patterns; • Add or edit materials; • Review submissions; • Approve or reject content; and • Perform other authorized functions. Administrative access does not create an ownership interest in the Service or its intellectual property.
20. Third-Party Services
The Service may rely on third-party providers for: • Authentication; • Payment processing; • Hosting; • Database services; • Email; • Analytics; and • Cloud infrastructure. Your use of certain third-party services may be subject to separate terms.
21. Service Availability
We do not guarantee uninterrupted or error-free access to the Service. The Service may be unavailable because of maintenance, software updates, network failures, third-party outages, security events, or other circumstances.
22. Backups and Data Loss
Although we may maintain backups and employ reasonable technical measures, we do not guarantee that user-entered information will never be lost. You are encouraged to maintain independent records of important information.
23. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHAFTOE CONSOLIDATED DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT: • THE SERVICE WILL BE ERROR-FREE; • INFORMATION WILL ALWAYS BE ACCURATE; • PATTERN INFORMATION IS COMPLETE; • MATERIAL SUBSTITUTIONS WILL PRODUCE DESIRED RESULTS; • HATCH INFORMATION IS CURRENT; OR • RECOMMENDED FLIES WILL CATCH FISH.
24. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHAFTOE CONSOLIDATED AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF SHAFTOE CONSOLIDATED FOR CLAIMS ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF: 1. THE AMOUNT YOU PAID TO THE COMPANY FOR THE SERVICE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR 2. ONE HUNDRED U.S. DOLLARS ($100).
25. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Shaftoe Consolidated and its affiliates, officers, employees, and contractors from claims arising out of: • Your User Content; • Your violation of these Terms; • Your violation of another person’s rights; or • Your unlawful use of the Service.
26. Termination
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe that you: • Violated these Terms; • Created legal or security risks; • Abused the Service; or • Used the Service fraudulently.
27. Changes to the Terms
We may modify these Terms. When material changes are made, we may provide notice through the Service, email, or another reasonable method.
28. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
